1. Acceptance of these terms
These Terms and Conditions (“Terms”) govern your access to and use of the Fuel Calculator MW mobile application, website, content, and related services (together, the “Service”), provided by Amaranth Solutions (“we”, “us”, or “our”). By installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service does
The Service helps users estimate fuel requirements and costs using route information, government or organisational standards, user-selected vehicle categories, custom consumption rates, fuel-price information, and other inputs. It may also provide saved routes, history, offline cached information, advertisements, banners, release notes, and software updates.
3. Estimates and no professional advice
All calculations, fuel prices, distances, route values, costs, and other results are estimates for planning and informational purposes. Actual fuel use and cost may vary because of traffic, road and weather conditions, driving style, vehicle condition, load, diversions, idling, price changes, incorrect inputs, and other factors.
The Service is not financial, engineering, mechanical, transport, procurement, or legal advice. A displayed “government” or standard calculation does not by itself constitute official approval, authorisation, or a fuel requisition. Users and organisations remain responsible for verifying the current rules and obtaining any required approvals.
4. Eligibility and acceptable use
You must be legally capable of agreeing to these Terms. You agree to use the Service lawfully and responsibly. You must not:
- interfere with, overload, damage, bypass, or attempt unauthorised access to the Service or its servers;
- use automated means to scrape, copy, or extract substantial parts of the Service;
- reverse engineer or modify the App except where applicable law expressly permits it;
- introduce malicious code, impersonate another person, or use the Service for fraud; or
- remove ownership notices or use our branding in a misleading way.
5. Your inputs and responsibilities
You are responsible for the accuracy of the routes, categories, distances, consumption rates, local-running fuel, fuel type, and other information you enter. You should review each result before relying on it and keep independent records where calculations are used for business, government, reimbursement, or compliance purposes.
You are also responsible for protecting your device and for any activity through your copy of the App.
6. Fuel prices, standards, and third-party information
Fuel prices, route tables, government standards, and other information may be provided by public sources, administrators, or third parties and may be delayed, incomplete, or inaccurate. “Last updated” information does not guarantee that a value is currently in force. You should verify important information with the relevant fuel retailer, authority, employer, or official publication.
7. Advertisements and third-party services
The Service may display advertisements supplied by Google AdMob or other partners and may contain links to third-party websites or services. We do not control and are not responsible for third-party content, offers, privacy practices, availability, or transactions. Your use of a third-party service is governed by that provider’s own terms.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, branding, compilations, and original content, is owned by or licensed to Amaranth Solutions and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to install and use the App for its intended purpose.
These Terms do not transfer ownership to you or permit you to reproduce, distribute, sell, sublicense, or commercially exploit the Service or our branding without prior written permission.
9. Availability, updates, and changes
We may update, add, remove, suspend, or discontinue features or content, and may require you to install a supported version. Internet-dependent features may be unavailable because of network, hosting, maintenance, or third-party issues. Offline data may become outdated. We do not guarantee uninterrupted or error-free operation.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, availability, or results. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
11. Limitation of liability
To the fullest extent permitted by law, Amaranth Solutions and its personnel will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, revenue, data, opportunity, fuel, or business arising from your use of or inability to use the Service.
We are not responsible for loss caused by reliance on an estimate, outdated price or standard, incorrect user input, route change, vehicle performance, third-party content, or service interruption. These limitations do not apply where liability cannot legally be limited, including liability arising from fraud or wilful misconduct.
12. Indemnity
To the extent permitted by law, you agree to reimburse us for reasonable losses, claims, and costs arising from your unlawful misuse of the Service, infringement of another person’s rights, or material breach of these Terms.
13. Termination
You may stop using the Service and uninstall the App at any time. We may suspend or terminate access if you materially breach these Terms, misuse the Service, create security or legal risk, or if the Service is discontinued. Provisions that by their nature should survive termination will remain effective.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Malawi, without regard to conflict-of-law principles. The courts of Malawi will have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
15. Changes to these Terms
We may revise these Terms as the Service or applicable law changes. The updated version will be posted on this page with a revised effective date. Continuing to use the Service after revised Terms take effect means you accept them, to the extent permitted by law.
16. General provisions
If a provision is held unenforceable, the remaining provisions remain in effect. A delay in enforcing a right is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms and the Privacy Policy form the agreement between you and us concerning the Service.
